    Understanding Mediation and Arbitration:

    Q: What is Mediation?

    Mediation is a process whereby a neutral third person, the mediator, acts to encourage and facilitate the resolution of a dispute between two or more parties. It is an informal and non-adversarial process, which has the objective of helping the disputing parties, reach mutually acceptable and voluntary agreement. 

    In mediation, decision-making and authority rests entirely with the parties. The mediator acts as a facilitator, guiding the parties in identifying issues, engaging in joint problem solving, and exploring creative settlement alternatives.

    Q: What is Arbitration?

    Arbitration is the process whereby a neutral third party hears the disputants’ arguments and imposes a final and binding decision that is enforceable by the courts.

    Q: What is the purpose of mediation/arbitration?

    The purpose is to use mediation/arbitration to promote principles and practices that will facilitate communication and working relationships. The goal is to help contesting parties obtain resolution of their dispute using an appropriate dispute resolution process. The mediation/arbitration process allows parties to resolve their differences quickly, less formally, less adversarial, and with more efficient use of resources than traditional dispute mechanisms (i.e. litigation).

    Q: In what order are mediation and/or arbitration used?

    We strongly suggest that the parties mediate prior to arbitrating. Mediation can save time and money, by either resolving the matter or narrowing the issues to be arbitrated.

    Q: Who should use mediation/arbitration?

    The use of mediation and/or arbitration is encouraged for all employees. Its applicability to particular disputes shall be determined collaboratively between the employee and management.  

    Q: Do I need representation?

    All parties should have legal representation; if not, resources will be provided for finding little to no-cost legal representation.
